1. Acceptance of Terms

By accessing or using FuchsTravels ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Eligibility

You must meet the following requirements to use our Service:

• You must be at least 16 years old
• You must have the legal capacity to enter into binding contracts
• You must not be prohibited from using the Service under applicable laws
• If booking on behalf of others, you must have authority to accept these Terms for them

3. User Accounts

Account Creation

• You must provide accurate, current, and complete information
• You are responsible for maintaining account security
• You must notify us immediately of any unauthorized use
• One person may not maintain multiple accounts

Account Responsibilities

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to comply with account security requirements.

4. Bookings and Payments

Booking Process

• All bookings are subject to availability and confirmation
• Prices are subject to change until booking is confirmed
• You must provide accurate participant information
• Special requirements must be communicated at booking

Payment Terms

• Full payment is required to confirm booking unless otherwise specified
• We accept major credit cards and other specified payment methods
• All payments are processed securely through third-party providers
• Prices are displayed in USD unless otherwise noted

Travel Insurance

We strongly recommend purchasing comprehensive travel insurance. FuchsTravels is not responsible for costs incurred due to trip cancellation, medical emergencies, or other unforeseen circumstances.

5. Cancellation and Refund Policy

Standard Cancellation Policy

• 30+ days before departure: Full refund minus processing fee
• 15-29 days before departure: 50% refund
• 7-14 days before departure: 25% refund
• Less than 7 days: No refund

Organizer Cancellations

If a tour is cancelled by the organizer, you will receive a full refund. We are not responsible for any additional costs incurred (flights, accommodation, etc.).

Force Majeure

Neither party shall be liable for cancellations due to force majeure events including but not limited to: natural disasters, war, terrorism, epidemic, government actions, or other unforeseeable circumstances.

6. Tour Organizer Terms

If you are a tour organizer using our platform, you additionally agree to:

• Provide accurate tour descriptions and pricing
• Maintain appropriate licenses and insurance
• Comply with all local laws and regulations
• Deliver services as described in tour listings
• Respond promptly to customer inquiries
• Maintain professional standards of conduct

Commission and Fees

Organizers agree to pay FuchsTravels a commission of 15% on all bookings made through the platform. Additional fees may apply for premium features or services.

7. User Content

Content License

By posting content on FuchsTravels, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute your content in connection with the Service.

Content Standards

You agree not to post content that:

• Infringes intellectual property rights
• Contains false or misleading information
• Is defamatory, offensive, or harmful
• Violates privacy rights
• Promotes illegal activities

8. Prohibited Activities

You agree not to:

• Use the Service for any unlawful purpose
• Impersonate any person or entity
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to any part of the Service
• Use automated systems to access the Service without permission
• Collect user information without consent
• Post spam or unsolicited promotional content
• Circumvent any security measures

You agree to indemnify and hold harmless FuchsTravels, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service or violation of these Terms.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of San Francisco County, California.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
